Balance Restoration Campaign Terms
PLEASE READ THESE TERMS AND CONDITIONS OF PARTICIPATION IN THE LIFE IS FEUDAL: MMO BALANCE RESTORATION CAMPAIGN (HEREINAFTER REFERRED TO AS THE “CAMPAIGN”) CAREFULLY. BY PARTICIPATING IN THE CAMPAIGN, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED HERE BY REFERENCE.
1. Campaign General Terms
1.1. Participation in the Campaign is offered collectively by Long Tale Games, LLC and Xsolla (USA), Inc. (“we”, “our”, “us”). The Campaign is available to individuals for their personal engagement use solely.
1.2. By participating in the Campaign, you (“player(s)”, “your”, “yours”) confirm that you have read, understood and agree to be bound by these Terms and Conditions, Xsolla Account Terms of Use and any other terms and conditions which may apply to the Campaign and your participation in it (collectively referred to as “Governing Terms”). If you do not agree to the Governing Terms you cannot participate in the Campaign.
2. Campaign Overview
2.1. The Campaign is designed to reward and thank the players of the video game “Life is Feudal: MMO” (hereinafter referred to as the “Game”, “Project”).
2.2. In order to enroll in the Campaign, you shall have an active Xsolla Account. If you ever made purchases in the Game prior to its official shutdown, we will credit so-called “LiF Сoins” (also hereinafter referred to as “bonuses”) to your balance at Xsolla Account in an amount determined at our sole discretion. For the purposes of these Terms, “bonuses” shall refer to the virtual currency determined in accordance with Xsolla Account Terms of Use.
2.3. Bonuses may only be used for purchasing the Game’s subscription, they may be used solely by you and cannot be transferred to or shared with others. Please be informed that if the amount of accrued bonuses is equal to or greater than the total cost of the subscription, then bonuses may be used to purchase the subscription without the need for other payment methods. If the amount of bonuses is less than the total cost of the subscription, you will need to use another payment method to cover the difference between the subscription cost and the amount of bonuses at your balance that you would like to redeem. Bonuses have no cash value, are non-transferable, and cannot be exchanged or returned for a monetary refund. More information about the bonuses can be found at Xsolla Account Terms of Use.
3. Term, Termination and Modification
3.1. The Campaign and its benefits are offered at our sole discretion. The Campaign is effective until terminated. We reserve the right, at our discretion, cancel, modify, restrict, or terminate these Terms and/or the Campaign or any aspect or feature of the Campaign at any time without prior notice.
3.2. We reserve the right to discontinue or terminate your participation in the Campaign at our sole discretion. Any illegal activity, fraud, misrepresentation, or other conduct inconsistent with the Governing Terms and/or detrimental to us or our interests, including without limitation, any suspected illegal, fraudulent, or unauthorized use of any Campaign features may result in the termination of further participation in the Campaign. In case of termination of participation in the Campaign any bonuses will be automatically terminated.
3.3. These Terms may be changed at our sole discretion from time to time with or without notice to you.
4. Disclaimer of Warranty and Limitation of Liability
4.1. We make no warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, in connection with the Campaign and these Terms. We do not and cannot warrant that the Campaign will operate without errors, or that it will be available at all times. Except as specifically provided herein, or otherwise required by the Governing Law, you agree that we, our subsidiaries, affiliates, officers, directors, employees, agents, or contractors are not liable for any indirect, incidental, special or consequential damages under or by reason of any services or products provided herein or by reason of your participation in the Campaign, including loss of profits, revenue, data or use by you or any third party, whether in an action in contract or tort or based on a warranty or any other legal theory. We make no warranty that: The Campaign will be uninterrupted, timely, secure or error-free; The Campaign will meet your requirements or expectations; The results that may be obtained from your participation in the Campaign will be accurate or reliable; Any errors in the Campaign will be corrected. The Campaign and granting you any bonuses under no circumstances can be considered as any kind of our liabilities or fault. We shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use data or other intangible losses resulting from: The use or the inability to participate in the Campaign and to use its features; Unauthorized access to your Account within the Campaign; Unauthorized alteration of your data; Statements or conduct of the third party service provider; Any other matter relating to the Campaign.
5. Miscellaneous
5.1. These Terms and their interpretation shall be governed in all respects by the laws of the State of California, USA, without giving effect to any principles that may provide for the application of the law of another jurisdiction (“Governing Law”). Any disputes arising out of or related to these Terms or your participation in the Campaign shall be settled in the state courts of California without giving effect to the conflicts of laws principles thereof.
5.2. Any matter that has not been explicitly set forth herein shall be governed by and interpreted in accordance with the Governing Terms and the Xsolla Account Terms specifically. In case of any discrepancies in the Governing Terms the terms and provisions of Xsolla Account Terms shall prevail.
